What Your Clients' IEP Cases Require That Most Family Law Firms Cannot Provide
When a child with a disability is at the center of a custody dispute, the IEP becomes a legal document, one that touches decision-making authority, parental rights, school compliance, and the child's federally guaranteed right to a Free and Appropriate Public Education.
Most family law attorneys are skilled litigators. But IDEA, FAPE, LRE, prior written notice, stay-put rights, and IEP team composition are not taught in family law CLE, and getting them wrong in a custody order creates enforcement problems that outlast the divorce.
That is the gap that the IEP Lawyers fill. We are not a competing firm. We are your IEP subject matter expert, the specialist you bring in so your client gets the right outcome, and you get the right language in order.
Best Interest of Child: Who decides?
Which parent has final say on IEP decisions when legal custody is shared?
Can one parent unilaterally pull a child from special education services?
Who has the right to request an IEP meeting, and what notice is required?
Best Interest of the Child: Who is holding the school accountable?
Is the school actually complying with the existing IEP, or just claiming to?
Who has the right to request an IEP meeting, and what notice is required?
What happens to a child's IEP when they relocate to a new school district?
Best Interest of the Child: Is the Child’s Educational Needs Being Met?
How should the custody order address consent for evaluations and re-evaluations?
Is the school using discipline as a workaround to deny services the IEP requires?
Is the school pitting parents against each other to avoid providing services and accommodations?

Why the Audit Requirement Matters, And Why It Benefits Your Client
We do not draft IEP provisions for a custody order without first conducting an IEP audit. Generic IEP language in a custody order is not enforceable the way specific, record-grounded language is. The audit ensures that what goes into the order reflects what this child actually needs, not a template. It also means that when the parents meet us through this process, they are meeting an attorney who has read every page of their child's file. That matters for the families we ultimately serve.

Q: Can you consult on IEP matters in states where you are not barred?
1
Yes. Our expert consulting services include IEP audits, declarations, custody order IEP provision drafting, meeting attendance, and expert testimony. The services are available in all 50 states. We serve as the IEP subject-matter expert supporting the family's representation. You remain attorney of record. There is no geographic limitation on expert consulting, and no bar admission is required for us to serve in this capacity. We have active of-counsel relationships in select jurisdictions for matters requiring direct family representation.
How quickly can you turn around an IEP audit?
2
Standard turnaround for an IEP audit and written evaluation is 10-14 business days after receipt of the complete file and payment of the engagement retainer. Rush turnaround (under 72 hours) is available with a 40% surcharge on the flat fee. Turnaround for declarations, once an audit is complete, is typically 5-7 business days. Contact us to discuss timeline requirements before submitting your inquiry.

All of these terms are specified in the engagement letter before any appearance is scheduled, so there are no surprises on the invoice.
